No. In a REIT the investor invests in a company = No real control (you have to trust the managers). In this situation the investor invests in the actual mortgage = Total control of the asset.
How exactly would the investment happen?
Here is a scenario:
-SLM originates a loan.
-The loan closes in SLM name.
-SLM will show all loan docs to a potential mortgage investor.
-If the investor is interested in that deal they will indicate interest.
-The mortgage is then "assigned" to the investor through a title company.
-This is exactly how one large bank assigns a mortgage to another.
-The mortgage assignment is recorded with the county where the property is located.
-The investor now has complete control of the mortgage and the property.
-Monthly payments will be made to the investor by SLM.
-If the property goes into foreclosure the investor can either keep the property or sell the mortgage back to SLM at face value.
What information will you need from each investor?
-We need to qualify each investor as "sophisticaed" from a SEC perspective.
-We need to vet investors from the "patriot act" perspective.
